Welcome to Learn Musiq, the online website platform connecting students to music and dance. These Terms and Conditions are a legally binding agreement between you and the Administrator governing your interactions with and use of the Platform.

TERMS AND CONDITION

Please read the Terms and Conditions [“Terms”] carefully before using Learn Musiq Academy and its  Website as they constitute a legally binding agreement between you and the Learn Musiq academy. Before accessing, downloading, or using any part of the Service, you should carefully review the following Agreement. We provide the Service to you only on the condition that you accept all of the Terms and Conditions stated in this Agreement. Accessing, downloading, using the Service, and/or attending Learn Musiq constitutes your agreement to be bound to the Terms and Conditions posted on this site, which is incorporated into this Agreement by reference. This Agreement will take effect at the moment you submit your enrolment ("Enrolment") electronically and/or in hardcopy form, and/or begin accessing, downloading, using the Service, and/or attending Learn Musiq classes, whichever is earliest. All references herein to "Applicant" or "You" refer to any user of this Site and the Service. Parents/Legal guardians accept the Terms and Conditions on behalf of their children. If you do not agree with this Agreement, you are not granted permission to access or otherwise use our Service. By accessing or using the Learn Musiq Academy Website or any related service, you agree to comply with and be bound by these Terms along with the Privacy Policy.

For the Tutor:

1. Creating an Account:
   
   

1. You must register/create an account and provide basic information like Aadhar or Pan and certification as preferred by the Administrator to access features that are offered through the Platform. If the trainer is not from India, then country specific documents needs to be uploaded. We promise that the credential information provided to us will be secured confidentially and will not disclose to anyone. You are responsible for maintaining the confidentiality of your account password. You are also responsible for all activities that occur in connection with your account. You agree to notify us immediately of any unauthorized use of your account. Your account is for your individual use only.
   
   

2. You must provide complete and accurate information about yourself when creating your account. You may not impersonate someone else (e.g., adopt the identity of anyone other than yourself), 

3. You cannot assign or otherwise transfer your account to another entity or person without consent from us.
   
   

4. You are liable for any activities conducted through your account. You must immediately notify Learn Musiq Academy if you know or have any reason to suspect that your credentials have been lost, stolen, misappropriated, or in case of any actual or suspected unauthorized use of your account.

2. Communications with the Learn Musiq: By creating an account, you agree to receive certain communications in connection with the Platform. Types of Communication will be via email or WhatsApp.
   
   

3. Teachers and Students are referred to as USERS for this document. You hereby unequivocally give authorization and grant permission to the Company to record audio, video, and images during the class and events that are conducted by the Academy through its Platform and all related social media channels to the extent required to improve services offered by the Academy and as applicable for marketing and advertising purposes.
   
   

4. Teacher:

1. Has to submit the Bank account details for the payment. The teacher receives the payment on any date between the 3rd to 10th of every month and the next consecutive payment will be calculated from the last received payment date.
   
   

2. Recordings will be done during the commencement of each class by the teacher. If the recording isn’t done the payment for that particular class will not be paid by the academy. Generally, the Administrator may review recordings for quality purposes.
   
   

3. The Administrator reserves the right to remove Recordings without prior notice for any reason or no reason.
   
   

4. Teacher is strictly not allowed either to ask for personal information about any student or give any contact details about themselves and must never ask about the fees details. If did so will have to pay a penalty and will be terminated from their job at the academy.
   
   

5. No intimidation or bullying is allowed in the class if did so will have to pay a penalty of Rs 2,00,000 to 5,000,00 and the payment for the Teacher will not be paid from the company if the latter does so. And also will be dismissed from their role as a teacher and terminated
   
   

6. If the provided details are not true after the verification then the administrator has all rights to cancel the agreement and terminate their job.
   
   

7. Classes must be conducted from the provided link only and it is appropriate for the videos too. If students ask any doubts or out of syllabus questions, the teacher must get permission from the Administrator.
   
   

8. Teachers should never give the link to any third party or the videos if did so will not continue their job in the academy.
   
   

9. Teacher will be asked to take a demo session for 30 minutes and no payment will be provided for this demo session.
   
   

10. Teacher must get permission from the academy for any leave or permission 24 hours before the class and even in case of rescheduling or cancellation too. Too much leave must be avoided as this might not give a good impression to the students about the discipline and the punctuality. The teacher must mind the timing of the class and must start the class at the given appropriate time. Incentives will be provided for their discipline and if they are regular with no absenteeism.
    
    

11. If the teacher has any problem with the student or doesn’t like to take a class for any particular student because of their behavior, the teacher is welcome to inform the administrator regarding the inconvenience and can report it through mail or WhatsApp.
    
    

12. In case of Internet Connectivity or issues in classes, the tutor should ONLY report to the admin. This can be communicated through whatsapp or mail. Under no circumstances the tutor should raise queries to the student or parents. 

5. Teachers further agree that you will not post or transmit any image of another person without that person’s consent. You may not use the Platform in any manner that could damage, disable, overburden, or impair the Academy servers. You may not attempt to gain unauthorized access to any services or information to which you have not been granted access through password mining or any other process.

6. The trainer agrees to work under the payment ranges offered by Learn Musiq. 

7. The Tutor should be having access to a minimum internet speed of 20mbps, a standard working laptop, tablet or mobile phone whichever the academy demands to be able to take classes.

8. From the date of being officially a part of Learn Musiq, if under any circumstances you won’t be able to continue your services a 60 day formal notice & serving period is vital. If not given a notice, penalty would be levied depending upon damages caused at the moment. 

9. At our sole discretion, we may take any legal and technical remedies to prevent the violation of this Agreement and to otherwise enforce the Agreement.

10. Modification of Terms. Operator reserves the right, in our sole discretion, to change, modify, add, or remove portions of this Agreement at any time. Such changes will be posted on the Platform website and information about material changes will be emailed to you via the email address you have provided. The sting of changes constitutes your binding acceptance of such changes.

11. You will not use the Platform to create a business of any kind for yourself that takes place outside of the Platform.

12. Disclaimer of warranties and limitation of liability / other disclaimers: The platform and all information, content, materials, products, and services included on or otherwise made available to you through this platform are provided by us on an "as is" and "as available" basis. operator makes no representations or warranties of any kind, express or implied, as to the operation of the platform or the information, content, materials, products, or services included on or otherwise made available to you through this platform.

13. Operation and Content: The Administrator is not responsible for any incorrect Content posted on or in connection with the platform, whether caused by users of the platform, members, or by any of the equipment or programming associated with or utilized in the platform. The Administrator assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, or unauthorized access to, or alteration of, user communications. The Administrator is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the internet or at any website or combination thereof, including injury or damage to users or to any other person's computer related to or resulting from participating or downloading materials in connection with the web and/or in connection with the platform.
    
    

14. User Conduct: The Administrator is not responsible for the conduct, whether online or offline, of any user of the platform. under no circumstances will the Administrator or any of its affiliates, advertisers, promoters, or distribution partners be responsible for any loss or damage, including personal injury, or death, resulting from anyone's use of the platform, any content posted on the platform, or transmitted to users, or any interactions between users of the platform, whether online or offline.
    
    

15. The Learn Musiq academy platform is solely intended for use by individuals residing anywhere in the world. Anyone accessing the platform from a location outside India is responsible for compliance with any applicable local laws
    
    

16. The Terms shall be governed by and construed by the laws of India, without regard to conflict of law principles.
